1. INTRODUCTION

These Terms of Service (“Terms”) govern your access to and use of the InsightifAI platform (“Service”), provided by CodeWise OÜ (“Company,” “we,” “us,” or “our”), a company registered in Estonia.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use the Service.

2. SERVICE DESCRIPTION

InsightifAI is an AI-powered data analytics platform that:

  • Fetches customer data via authorized API connections.
  • Creates a consolidated data lake by integrating data from multiple SaaS applications.
  • Provides natural language querying capabilities for data analysis without requiring SQL or advanced analytics expertise.

3. USER ACCOUNTS

3.1. To access the Service, you must register for an account.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3. You must provide accurate, current, and complete information during registration and ensure its accuracy throughout your use of the Service.

4. DATA COLLECTION AND PROCESSING

4.1. Data Sources: The Service accesses your data from third-party applications via API connections that you authorize.

4.2. Data Usage: We process your data solely to provide the Service. We do not sell or share your data with third parties, except as necessary to deliver the Service or as required by law.

4.3. Data Security: We implement reasonable technical and organizational measures to protect your data.

4.4. Data Rights: You retain all rights to your data and may request its export, correction, or deletion in accordance with applicable laws.

5. LICENSE TO USE

5.1. We grant you a non-exclusive, non-transferable license to use the Service for your internal business purposes.

5.2. You shall not:

  • Sublicense, sell, rent, lease, or otherwise transfer your access rights.
  • Reverse-engineer or attempt to extract the source code.
  • Use the Service for any unlawful purpose or in violation of applicable laws.

6. LIMITATION OF LIABILITY

6.1. Best Effort Service: The Service utilizes AI and machine learning models to analyze data and generate responses. You acknowledge that:

  • The Service operates on a best-effort basis.
  • Large Language Models (LLMs) may produce inaccurate, incomplete, or misleading information.
  • LLMs can make mistakes similar to human errors.
  • The Company does not guarantee the accuracy, completeness, or appropriateness of generated insights.

6.2. No Warranty: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.3. Decision Making: You are solely responsible for any decisions made based on the information provided by the Service. We recommend independent verification before making critical business decisions.

6.4. Limitation of Liability: IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, OR DATA.

7. PUBLICITY

7.1. By using the Service, you grant the Company the right to use your company name and logo for marketing purposes, including but not limited to:

  • Customer reference lists
  • Website testimonials
  • Marketing materials
  • Case studies
  • Social media posts

8. INTELLECTUAL PROPERTY

8.1. The Service, including all software, features, and content (excluding your data), is owned by the Company and protected by intellectual property laws.

9.1. We will maintain the confidentiality of your data and will not disclose it to third parties except as necessary to provide the Service or as required by law.

9.2. This confidentiality obligation survives the termination of these Terms.

10. TERM AND TERMINATION

10.1. These Terms remain in effect until terminated by either party.

10.2. You may terminate these Terms by ceasing to use the Service and closing your account.

10.3. We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that violates these Terms.

10.4. Upon termination, your right to use the Service will immediately cease.

11. GOVERNING LAW

11.1. These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to conflict-of-law principles.

11.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.

12. CHANGES TO TERMS

12.1. We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website or through the Service.

12.2. Your continued use of the Service after such modifications constitutes acceptance of the revised Terms.
